National Adoption Month: What Expectant Mothers Should Know About Adoption in Florida
November is National Adoption Month, a time to recognize the families created through adoption and, most importantly, the expectant mothers whose decisions help make those families possible.
If you are pregnant and considering adoption in Florida, you probably have questions. You may wonder how the adoption process works, whether you can choose the adoptive family, what financial assistance is available, or what rights the baby’s biological father may have.
At Heart of Adoptions, we believe every expectant mother deserves compassion, support, and accurate information to make the decision that is right for her and her baby. You do not have to make a decision today. Learning about your options is a great place to start.
How Does Adoption Work in Florida?
Choosing adoption is a personal decision, and the process should never feel rushed or pressured. If you are considering adoption, here are some things you should know:
- You can choose the adoptive family. You have the opportunity to review family profiles and select a family that feels right for you and your baby.
- You may qualify for financial assistance. Florida law allows certain pregnancy-related living and medical expenses to be paid on behalf of an expectant mother.
- You have the right to your own attorney. We strongly encourage separate legal representation for everyone involved in an adoption. Your attorney represents your interests, and there is no cost to you for your legal representation.
- You can explore open adoption. You may discuss the possibility of receiving pictures, letters, updates, or ongoing communication with the adoptive family.
- You have legal rights. Florida has specific requirements regarding adoption consent, biological fathers, and the adoption process. It is important to understand these requirements before making any decisions.
What Should I Know About the Birth Father’s Rights?
One of the most common questions expectant mothers have is whether the biological father has to agree to an adoption.
Florida law recognizes certain rights for biological fathers, and those rights depend on individual circumstances. Factors may include whether the parents are married, whether paternity has been established, and whether the biological father has taken the required legal steps to preserve his rights.
Florida also has a Putative Father Registry, which allows certain unmarried biological fathers to register and preserve specific rights relating to adoption proceedings.
If you are unsure about the biological father’s rights or are concerned about his involvement, it is important to speak with an agency or independent attorney. Our agency works with experienced Florida adoption attorneys to help ensure everyone’s legal rights are properly addressed.
You should never have to navigate these questions alone.

Why Is Separate Legal Representation Important?
At Heart of Adoptions, we advocate for independent legal representation for everyone involved in an adoption.
This means the expectant mother has her own attorney, the adoptive parents have their own attorney, and the biological father’s legal interests are addressed when applicable.
We work with some of the most experienced adoption attorneys in Florida because protecting everyone’s rights and best interests is important.
An attorney can be provided at no cost to you as the expectant mother. You should have someone whose responsibility is to explain your rights, answer your questions, and represent your interests throughout the process.
Does It Cost Anything to Place a Baby for Adoption?
No. There is no cost to an expectant mother to make an adoption plan with Heart of Adoptions.
Depending on your circumstances and Florida law, assistance may be available for certain living expenses, medical expenses, counseling, and legal representation.
We can help explain what assistance may be available and guide you through the process.
